Is it important to hire a criminal defense lawyer early on, or should I wait until my case is filed or I am indicted?

In most cases, hiring a criminal defense lawyer to do an initial investigation can make the difference between having a criminal record and never having a criminal record. All felony cases must be heard by a Grand Jury. The Grand Jury will determine whether there is at least probable cause to believe a crime was committed. The Grand Jury hearing will be anywhere from a few weeks to a couple of months after the case is filed.

Once the Felony case is filed, but before the Grand Jury hearing, the Defendant has the right to have an examining trial. At the examining trial, the criminal defense lawyer can cross examine the police officers that filed the case and view the police report. If you do not have a lawyer to scrutinize the evidence and do an independent investigation, then the Grand Jury will likely indict the Defendant.
