Federal Conspiracy to Distribute Case: Reduced 73.5%

Mr. Lowe’s client was arrested by the Drug Enforcement Administration and Mesquite Narcotics Task Force with the assistance of DPS on I-20 in Van Zandt County, Texas.  The client was determined to be in possession of 15 kilograms of powder cocaine.   Mr. Lowe’s client was ultimately charged with Conspiracy to Distribute 5kg (kilograms) or more of Cocaine in violation of 21 U.S.C. section 846 and 21 U.S.C. 841(b)(1)(A).   Mr. Lowe’s client was eventually indicted in the Eastern District of Texas and the case eventually assigned Federal District Judge Marcia Crone.  Mr. Lowe’s client faced a term of imprisonment not less than 10 years and no more than Life in Federal Prison (Federal Bureau of Prisons).

The indictment against Mr. Lowe’s client contained a total of 16 Defendants.  Mr. Lowe’s client was listed as the #4 Defendant in the original indictment.  All of the top 10 Defendants in the same indictment were either charged with Conspiracy to Distribute 5kg (kilograms) or more of Cocaine, Methamphetamine in violation of 21 U.S.C. section 846 and 21 U.S.C. 841(b)(1)(A) or a violation of 18 USC 924(c) or Possession of a Firearm in furtherance of a Drug Trafficking Crime.

Federal District Judge Crone determined that the total offense level applicable to Mr. Lowe’s client was 31 with a criminal history category of II.  Therefore the applicable federal sentencing guidelines range was 121 months to 151 months with a 5 year supervised released time period.  Mr. Lowe’ client received a 40 month sentence and 5 years supervised release and a $100 special assessment.  Mr. Lowe was able to obtain sentence for his client that was 73.5% lower than the maximum applicable guideline sentence on his case.

Defendant #3:   56 Months

Defendant #5:   262 Months

Defendant #6:   Unapprehended

Defendant #7:   48 Months

Defendant #8:   46 Months

Defendant #9:   135 Months

Defendant #10:  178 Months

 

Mr. Lowe’s client will complete the RDAP program in the Bureau of Prisons. In this case, Mr. Lowe’s client will likely only serve a total of 22 months in prison.
