.14 breath test case dismissed and client received Obstruction of a Passageway after jury selection
Mr. Lowe able to persuade the Dallas County District Attorney's Office to dismiss DWI where client allegedly failed all field sobriety tests and failed the breath test with a .142 test result. Mr. Lowe's investigation into the intoxilizer maintenance records revealed mechanical problems with the intoxilizer 5000 machine. After picking a sympathetic jury, the DA's office agreed to dismiss the case and allowed Mr. Lowe's client to receive a deferred adjudication on an Obstruction of a Passageway. Client's DWI charge will be expunged and the the Obstruction will be sealed upon client's successful completion of probation.
